This website is operated by Sooper Kids ("Company", "we", "us", "our"). By visiting sooperkids.com ("the Site") and/or placing an order, you ("Customer", "user", "you") engage in our service and agree to be bound by the following Terms of Service ("Terms"), including all policies referenced herein.
Please read these Terms carefully before accessing or using the Site. By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree to all terms and conditions herein, you may not access the Site or use any of its services.
We reserve the right to update, change, or replace any part of these Terms at any time by posting updates to this page. It is your responsibility to review this page periodically. Continued use of the Site following any changes constitutes your acceptance of the revised Terms.
Our store is hosted on Shopify Inc., which provides the e-commerce platform through which we sell our products.
Section 1 - Eligibility and General Use
By using this Site, you represent and warrant that:
You are of legal age to form a binding contract under the laws of your jurisdiction, or are accessing the Site under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. You will not use our products or the Site for any unlawful or unauthorised purpose. You will not transmit any malicious code, viruses, or harmful data through the Site. You will not violate any applicable local, national, or international law in connection with your use of the Site.
A breach of any of these Terms will result in immediate termination of your access to the Site and its services.
Section 2 - Nature of Products and Order Confirmation
The Customer expressly acknowledges that all products sold on the Site are handmade and manufactured on a made-to-order basis. Each item is custom-produced upon receipt of a confirmed order. As such:
All sales are final upon order confirmation. Orders cannot be cancelled or modified once confirmed and production has commenced. Minor variations in colour, texture, finish, or dimensions inherent to the handmade process are a characteristic feature of our products and shall not constitute a defect or grounds for any claim. Product images on the Site are representative. Due to the handmade nature of our products and variations in screen display settings, actual colours and textures may differ slightly from what is depicted.
Section 3 - Pricing and Order Modifications
All prices are listed in Pakistani Rupees (PKR) and are subject to change without notice. We reserve the right to modify, suspend, or discontinue any product or service at any time without notice. We reserve the right to refuse, limit, or cancel any order at our sole discretion, including orders that appear to be placed by resellers or distributors. In the event an order is cancelled or modified by us, we will notify you via the contact information provided at checkout. We shall not be liable to you or any third party for any modification, price change, suspension, or discontinuance of any product or service.
Section 4 - Payment
Sooper Kids offers flexible payment arrangements as follows:
Full upfront payment: the Customer may elect to pay the full order amount in advance via bank transfer, EasyPaisa, or JazzCash. Partial advance payment: depending on the nature and value of the order, Sooper Kids may require an advance payment of either 20% or 50% of the total order value at the time of order confirmation. The remaining balance shall be collected via Cash on Delivery (COD) upon delivery, or settled upfront at the Customer's election. Cash on Delivery (COD): where no advance is required, the full order amount is payable in cash upon delivery.
Refusal to accept or pay for a delivered order without valid grounds may result in retention of any advance payment as liquidated damages and future orders being declined at our sole discretion.
Section 5 - No Open Parcel Policy
Sooper Kids does not offer an open parcel facility. The Customer is required to make full payment to the courier upon delivery before opening or inspecting the parcel. By placing an order, the Customer expressly acknowledges and accepts this condition. Any claims regarding the contents of the order may only be raised after payment has been made, strictly in accordance with our Refund and Exchange Policy and within the timeframes stipulated therein.
Section 6 - Accuracy of Information
You agree to provide accurate, complete, and current information at checkout, including your full name, delivery address, and contact number. Sooper Kids bears no liability for failed, delayed, or incorrect deliveries resulting from inaccurate information provided by the Customer.
We reserve the right to correct any typographical errors, inaccuracies, or omissions on the Site at any time without prior notice, including after an order has been placed.
Section 7 - Shipping and Delivery
Orders are dispatched through third-party courier services. Once an order has been handed over to the courier:
Risk in the goods passes to the Customer. Sooper Kids bears no liability for delays, losses, or damages caused by the courier. Estimated delivery timelines are indicative only and are not guaranteed.
Section 8 - Returns, Refunds and Exchanges
All returns, refunds, and exchanges are governed exclusively by our Refund and Exchange Policy, which forms an integral part of these Terms and is incorporated herein by reference. By placing an order, you confirm that you have read and accepted our Refund and Exchange Policy in its entirety.
Section 9 - Third-Party Links and Services
The Site may contain links to third-party websites or services, including but not limited to our courier partners and payment platforms. Sooper Kids is not responsible for the content, accuracy, or practices of any third-party websites. Any interactions you have with third parties are solely between you and that third party.
Section 10 - User Conduct and Submissions
Any feedback, reviews, comments, or other content you submit to the Site or to our social media channels may be used by Sooper Kids for promotional or operational purposes without obligation or compensation to you. You represent that any content you submit is accurate, does not infringe any third-party rights, and is not unlawful, defamatory, or harmful in any manner.
Section 11 - Intellectual Property
All content on the Site, including but not limited to text, product descriptions, photographs, graphics, logos, and design elements, is the exclusive property of Sooper Kids and is protected under applicable intellectual property laws. You may not reproduce, distribute, modify, or use any content from the Site without our prior written consent.
Section 12 - Errors, Inaccuracies and Omissions
Occasionally there may be information on the Site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, or availability. We reserve the right to correct any such errors and to update information at any time without prior notice, including after an order has been placed.
Section 13 - Disclaimer of Warranties and Limitation of Liability
The Site and all products and services are provided "as is" and "as available" without any warranties of any kind, express or implied. In no case shall Sooper Kids, its owners, employees, agents, or service providers be liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from your use of the Site or any products purchased through the Site.
Section 14 - Indemnification
You agree to indemnify, defend, and hold harmless Sooper Kids and its owners, employees, agents, and service providers from and against any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of or relating to your breach of these Terms, your violation of any applicable law, or your infringement of any third-party rights.
Section 15 - Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms without affecting the validity and enforceability of all remaining provisions.
Section 16 - Termination
These Terms remain in effect unless terminated by either party. We reserve the right to terminate your access to the Site at any time, without notice, if we determine in our sole judgment that you have violated any provision of these Terms. All obligations and liabilities incurred prior to termination shall survive.
Section 17 - Entire Agreement
These Terms, together with our Privacy Policy and Refund and Exchange Policy, constitute the entire agreement between you and Sooper Kids with respect to your use of the Site and supersede all prior agreements, communications, and understandings, whether oral or written.
Section 18 - Personal Information
Your submission of personal information through the Site is governed by our Privacy Policy, which forms part of these Terms and is incorporated herein by reference.
